The Hon'ble Supreme Court of India acknowledged the gravity of sexual harassment of working women at the workplace in Vishaka and Others Vs. State of Rajasthan and Others ("Vishaka Judgment") and established regulations requiring employers to prevent sexual harassment and to provide the procedures for the resolution, settlement, or prosecution of sexual harassment. In accordance with Article 141 of the Indian Constitution, the rules made by the Hon'ble Supreme Court were regarded as laws. It was essential to pass comprehensive legislation that focused on preventing sexual harassment and establishing a redress process because more women were working. The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (hence referred to as the "Act") was finally passed by India in 2013 after 16 years of Vishakha Judgment, for ending the practice of sexual harassment of women at the workplace. Sexual harassment at work is on the rise despite the fact that legislation and legal protections are being upheld. Sexual harassment of women employees in both the organized and unorganized sectors needs to be adequately addressed in order to promote gender inclusion in development and the building of a society free from violence. The aforementioned remarks only help to draw attention to the lack of knowledge on the extent of compliance with the Sexual Harassment of Women at Workplace Act, particularly in private sector organizations. This research study focuses on the level of compliance with the Sexual Harassment of Women at Workplace Act, especially in Private Sector Organizations, and offer a forum for open discussions and deliberations on the pertinent issues, dimensions, and new viewpoints on sexual harassment at work. It will also assist in developing an action plan for preventing sexual harassment of women employees and workers at the workplace and offer measures for doing so.
